Terms of Service

These Terms govern your use of GridSharks Limited's fantasy sports analytics platform (the "Service"). By using our Service, you agree to these Terms and our Privacy Policy. If you disagree, please don't use our Service.

1. Acceptance and Eligibility

By using GridSharks, you confirm you are:

• • Legally capable of entering these Terms
• • Compliant with all applicable laws in your jurisdiction
• • Providing accurate and complete information

2. Service Description

GridSharks provides fantasy sports analytics including AI recommendations, real-time analytics, statistical insights, and multi-league support (F1, NFL, Premier League, etc.).

Important: Our Service provides analytical tools for entertainment only. We don't guarantee fantasy performance outcomes. Recommendations are based on algorithms and statistics but fantasy sports involve chance and unpredictable variables.

3. Account Security

You must provide accurate information, maintain account security, use strong passwords, notify us of unauthorized access, and accept responsibility for all account activities. We may suspend accounts that violate Terms or pose security risks.

4. Subscription and Billing

Plans: Free (limited features), GridSharks League (advanced features), GridSharks Elite (unlimited access).

Billing: 7-day free trial for new users, automatic renewal unless cancelled 24+ hours before renewal, cancellation anytime via settings, refunds per our policy (Section 10), 30-day notice for price changes.

5. Acceptable Use

You may not: violate laws, disrupt the Service, gain unauthorized access, use bots without permission, reverse engineer software, share credentials, use commercially without authorization, or engage in harmful activities.

6. Intellectual Property

We own all Service content including algorithms, AI models, and analytics. We grant you a limited license for personal use. You retain data ownership but grant us license to process it for Service provision and improvement. We aggregate public sports data without claiming ownership of underlying statistics.

7. Beta Features

Beta features are provided "as-is" without warranties, may contain errors, can be modified or discontinued anytime, and you assume all risks. We may collect additional usage data for improvements.

8. Privacy and Consumer Rights

Our Privacy Policy governs data collection and use. Your data may be transferred internationally with appropriate safeguards. Nothing in these Terms limits consumer rights under New Zealand, Australian, EU, or other applicable consumer protection laws that cannot be waived.

9. Disclaimers and Liability Limitation

No Warranties: THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES. We don't guarantee accuracy, availability, or specific outcomes.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE'RE NOT LIABLE FOR INDIRECT DAMAGES, LOST PROFITS, FANTASY PERFORMANCE RESULTS, OR RELIANCE ON AI RECOMMENDATIONS.

Your Assumption of Risk: You acknowledge that fantasy sports involve skill and chance, and you use our recommendations at your own discretion and risk.

10. Termination and Refunds

Termination: You can terminate anytime via settings or support. We can terminate for Terms violations, fraud, security risks, or inactivity (12+ months for free accounts). Upon termination, access ceases and data may be deleted after 30 days.

Refunds: Free during trial, full refund for unresolvable technical issues, billing error corrections, 30-day satisfaction guarantee for new subscribers. Requests within 30 days to [email protected], processed in 5-10 business days.

11. Dispute Resolution

Contact [email protected] for informal resolution first. Consumers may use local dispute resolution (NZ Disputes Tribunal, Australian ACCC, EU ODR platform). Other disputes resolved through AMINZ arbitration in Auckland, New Zealand.

12. General Terms

Governing Law: New Zealand law governs these Terms without limiting your local consumer rights.

Force Majeure: We're not liable for delays due to circumstances beyond our control (natural disasters, government actions, cyber attacks, third-party outages).

Changes: We may update these Terms with 30 days notice for material changes. Continued use means acceptance.

Miscellaneous: These Terms plus our Privacy Policy constitute the entire agreement. If any provision is unenforceable, others remain valid. We may assign these Terms; you may not without our consent.
